Bladder Mesh Issue: Class Action Lawsuits has Little Benefits than Individual Lawsuits

bladder me lawsuitsMost women who suffered injuries from bladder mesh have decided to pursue medical device lawsuits against the device manufacturer, media reports say, affirming that most of those cases were filed by individuals.  A bladder mesh lawsuit allows women who are experiencing bladder complications the opportunity to obtain compensation for medical bills, pain and suffering and other damages resulting from their mesh surgery complications.

At present, about one hundred bladder mesh lawsuits have been filed.
Legal observers suggest that the victims should prefer an individual lawsuit rather than participate in a class action lawsuit.

Here are the advantages of pursuing an individual lawsuit
  • Claimants in class actions often wind up recovering very little
  • Lawyers representing class actions get paid huge fees.
  • Class action lawsuits can result in inadequate relief for those actually harmed by the product.
  • Class action lawsuit can hardly help recovering adequate compensation for the injuries.
A bladder mesh is implanted in women with urinary stress incontinence and pelvic organ prolapse.

However, it allegedly causes the following health risks and complications:
  • erosion through the vaginal epithelium;
  • reproductive system infections;
  • urinary problems;
  • recurrence of prolapsed;
  • vaginal pain;
  • abnormal bowel movement;
  • bladder or blood vessel perforation;
  • recurrence of incontinence;
  • vaginal scarring; and
  • painful sexual intercourse.

In October 2008 the US Food and Drug Administration (FDA) issued a warning about the use of this device. It further recommended that women should consult their doctors about alternatives to bladder mesh surgery.

In July 2011 the FDA announced that women who were implanted with a bladder mesh were at the greater risk for complications than those undergoing another type of surgery for pelvic organ prolapse repair. While the FDA has not yet issued a recall of bladder mesh devices, it has been advised that  women should consider weighing the risks and benefits of the procedure.

Various law firms stress that women who have suffered from bladder mesh complications may have legal recourse. Moreover, women who have experienced the earlier mentioned bladder mesh side effects may be able to participate in a similar legal action.

Hence, victims of bladder mesh devices should immediately seek legal advice about bladder mesh injury cases so that they will be guided and assisted on their endeavor.
